Extension of Telehealth Services Ends
A provision allowing high deductible health plans (HDHPs) to waive the deductible for telehealth and other remote care services without causing plan participants to lose the ability to contribute to a health savings account (HSA) will expire for calendar year plans on December 31, 2024.

IRS Releases Guidance on Qualified Medical Expenses
The Internal Revenue Service has released Notice 2024-71, Expenses Treated as Amounts Paid for Medical Care. The notice provides a safe harbor for qualifying medical expenses from a health flexible spending arrangement (health FSA), Archer medical savings account (Archer MSA), health reimbursement arrangement (HRA), or health savings account (HSA) for amounts paid for condoms.

IRS Releases Guidance on Preventive Care for Purposes of Qualifying as a High Deductible Health Plan
The Internal Revenue Service has released Notice 2024-75, Preventive Care for Purposes of Qualifying as a High Deductible Health Plan under Section 223. This notice expands the list of preventive care benefits permitted to be provided by a high deductible health plan (HDHP) to include over-the-counter oral contraceptives and male condoms.

Proposal Would Allow HSAs to Be Used for Pet Health Expenses
Representatives Claudia Tenney (R-NY), and co-sponsor Deborah Ross (D-NC), have introduced the People and Animals Well-being (PAW) Act. According to a press release, the bill would allow pet owners to use their health savings account or flexible spending account to pay for up to $1,000 for veterinary care or pet health insurance.

DOL Clarifies Cybersecurity Guidance
The Department of Labor has issued a compliance assistance release clarifying that cybersecurity guidance issued in April 2021 applies to all types of ERISA plans, including health and welfare plans and all employee pension benefit plans.
